EBay Revises User Agreement
In early May eBay announced changes to its user agreement, with the biggest changes focusing on the new eBay Resolutions policy, as well as the new eBay Purchase Protection policy (see “EBay Clarifies Buyer and Seller Protection Obligations”).
This past week Senior Counsel for eBay, Scott Shipman, announced that the latest revision would address obligations of buyers and sellers in transactions where a buyer has alleged receipt of a counterfeit item. Under the revised agreement:
Buyers and sellers shall work in good faith during the resolution process to determine that the item is not counterfeit.
If buyer and seller cannot determine that the item is not counterfeit, buyers are required to send the item back to the seller. Cost of return shipping will be paid by the buyer or eBay, unless both buyer and seller have agreed otherwise.
Covered claims that meet the conditions and are not excluded will count as a violation by the seller of eBay’s prohibited and infringing items policy.
If eBay determines the buyer is not acting in good faith, eBay may restrict or eliminate the buyer’s ability to return items or make future claims.
Sellers shall not list, advertise, or cause that item to appear for sale, barter or trade on any eBay Inc. Web site or service.
The new user agreement is effective immediately for new members registering, and on June 14, 2009, for current members. Customers who do not agree with the user agreement are advised by eBay to close their account.

Wow just had such a negative experience with VerticalResponse.com So I asked them to close account which is less then 3 hours old... I joined them as I seen competitor
using and liked the service.... I paid $240 loadeded 39,000 opt in emails we own
as the service states mail unlimited for the month for $240 up to 40,000.....
Everything looked awesome... Loaded list, loaded mailer then got bout 6 denials
of being able to email.... Which I fixed the issues... Then kept getting denials
and I was beginning to feel like a criminal for even trying to use the service.
Called customer service said whats the issue..... First they didnt want any emails
that contained Money making offers.... So changed the email to product based merchandise we sell.... Still Denied.....
So called back to VerticalResponse.com and then they had me on hold for eternity
and said after speaking with someone in the back we could only email 1000 people
out of the 39,000 we loaded...... I quickly told them I felt like I was a criminal for even trying the service and asked to close the account and be granted a refund.
They closed the account as requested

eBay announced a special new fee structure on Tuesday that goes into effect next month, but sellers say the five free auctions eBay is giving them may actually cost them more in commission fees than the old pricing structure, depending on the auction starting price and final selling price.
eBay is giving sellers five free auction-style listings per month with certain restrictions beginning June 16, 2009. Final Value Fees will be 8.75% of the sales price, capped at $20. Sellers must use eBay's Sell Your Item form or Simple listing form in order to be eligible for the new pricing. Any additional items sold during the same 30-day period will have the same Insertion Fees and Final Value Fees as they do currently. Sellers who use an eBay tool or third-party listing tools will not receive the special pricing.
Because eBay uses a tiered system to calculate Final Value Fees, the fees may be higher under the new fee structure - assuming the item sells - depending on the starting price and final selling price. Where the five free auctions incur an 8.75% commission capped at $20, the current commission is 8.75% of the initial $25.00, plus 3.50% of the initial $25.01 - $1,000.00 plus 1.50% of the remaining closing value balance ($1,000.01 - closing value).
Because the insertion fee is variable depending on the starting price, it's difficult to make comparisons. Sellers are using an online fee calculator to help them compare the rates.
